Cattany <br />City & County of Denver acting by & thru Bd of Water Comms Division Director <br />1600 W 12th Ave. Natural Resource Trustee <br />Mail Code 520 <br />Denver, CO 80204 <br />Re: Lupton Lakes Resource, Permit No. M-2004-078, Technical Revision Approval, Revision No. TR-05 <br />Dear Mr. Bambei Jr: <br />On October 2, 2009 the Division of Reclamation, Mining and Safety approved the Technical Revision application <br />submitted to the Division on September 22, 2009, addressing the following: <br />Combine mine phases 4-8, 9-12, 13-16 and I7-18 and increase maximum area to be mined at any one time to 100 acres. <br />However, the request to release 2.98 acres from the existing permit cannot be approved as part of TR-05, and will have to <br />be submitted to the Division as a separate acreage release request following the procedures outlined in 4.17.1 of the <br />Construction Materials Rule. <br />The terms of the Technical Revision No. 5 as approved by the Division are hereby incorporated into Permit No. M-2004- <br />078.
