III. COMMENTS-COMPLIANCE <br /> Below aye comments on the inspection. The comments include discussion of observations made during the inspection. Comments also <br /> describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a Partial inspection conducted by Janet Binns of CDRMS. The mine no longer extracts coal,but the remaining <br /> surface pit(Pit B)is permitted to dispose of flyash. CEC caps,regrades,topsoils,mulches and seeds the pit as the ash fill <br /> progresses. The weather was hazy and warm,with high light clouds. The mine site is dry,with CEC's records showing the <br /> only precipitation recorded in September was 0.32"on 9/12/2009. <br /> Records: The Division requested,and CEC provided a copy of the USR#1160 issued by Weld County Department of <br /> Health and Environment-Solid Waste Division. <br /> Roads: The haul road to the pit and return to the facilities were dry and well graded. Road side ditches are well graded and <br /> shaped. One ash truck was on site during the inspection. The operator said that they are currently hauling 5 truckloads of ash <br /> per day. The haul road and access road are in good condition with no concerns and no noxious weeds along the roadsides. <br /> Hydrologic Balance: The mine site was dry with both ponds; pond 2,and dugout pond dry. The puddles in Pit B have dried <br /> up as well. <br /> Backfill: CEC is placing ash on the upper lift of Pit B,north of the Area 31 R reclamation area. CEC was using a grader to <br /> spread out ash that had been recently dumped. No blowing of the ash or spoil cover was observed. No problems were noted <br /> with the ash placement and spreading. <br /> Revel etation and Reclamation Success: Sorghum seeded in Area 31R is very short,--6"high,and is drying up. CEC will <br /> seed the permanent seed mix into this sorghum cover crop this fall. CEC received their permanent seed on 9/16/2007. <br /> Reclaimed area 30 has established a healthy stable perennial vegetation stand. Species noted during the walk through that <br /> are well established include; indian ricegrass, buffalo grass, slender wheatgrass, switchgrass,prairie coneflower, side-oats <br /> grama grass,Little bluestem, Sand bluestem,and well established prickly pear. <br /> CEC mowed Reclaimed area 25 in an effort to knock down the annual species seeds <br /> CEC changed the reclamation success standards previously from reference areas to a formula standard. CEC plans to <br /> submit a revision to the permit to eliminate the maintenance of the reference areas from the permit. <br /> Panes of 4 Panac Matal Q/17nnnQfinifia1cI ihh <br />
