Sep 25 09 03:04p David Cressler
'CBCI Gravel
03037 CR 2
Dove Creek, CO 81324
(970)677-2797
(970)739-0324
970-677-3797
REURVED
SEP 2 8 2009
Division at K?aclamatioa,
Mining and Safety
P.1

September 23, 2009
RE: CBCI Gravel Pit, Response to Application Review Letter
Dear Mr. Oswald,
k s- Zu e9 -o30
Although we are on agreement with most of the items brought up in the review letter
there are a few point we would like to address.
Under Exhibit C-Mining Plan, the CBCI Gravel and the land owners, David and Linda
Cressler, have always been very stringent when it comes to the control of noxious weeds.
Dolores County itself also has very tight weed control policies. If the landowner does not
control the noxious weeds on their property the County can come in, spray them, and
then send the landowner a bill for the work. Although all of Colorado requires
landowners to control the noxious weeds on their property Dolores County has shown to
be the most adamant about following the law. Therefore noxious weed control will not
be an issue.
Even though the mining of shale rock is not the primary concern or purpose of the CBCI
Gravel pit, its presence may be utilized from time to time. Shale rock has shown to be
suitable for use as backfill material as well as an excellent road deicer. Therefore, some
shale rock may be stockpiled and utilized from time to time, though on a minor scale.
It is not projected that blasting be necessary but it should not be excluded as a means of
obtaining the desired material.
CBCI Gravel may also stockpile up to 500 cubic yards of imported backfill near the pit.
Due to the rocky composition of the site CBCI Gravel and Coal Bed Creek Construction
have stored various non-mining related items on the location of the gravel pit for several
years. At this time none of the items pose any risk, hazardous waste or otherwise, to the
operation. Due to the nature of the various jobs that Coal Bed Creek Construction is
involved in these items may be utilized in projects. In short, the nature of the items
stored at the location may change often. It is to be expected that as mining progresses
these items will have to be moved, but it is to be noted that none will be used as backfill
material during the reclamation process.
