NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, Mining and Safety proposes to approve an application <br />for a Phase II and Phase III Final Bond Release (Surety Release SL-2) submitted by Minrec, Inc. <br />for the Blue Ribbon Mine, Permit Number C-1981-047. The proposed decision is based on <br />successful completion of all required reclamation at the Blue Ribbon Mine. The mine is an <br />underground coal operation located in Delta County approximately seven (7) miles northeast of <br />Paonia, Colorado, north of Bowie Road. The permit area contains approximately 340.8 acres of <br />land within Section 2 of Township 13 South, Range 91 West and Section 35 of Township 12 <br />South, Range 91 West of the 6th P.M. The permit area is contained within the U.S. Geological <br />Survey 7.5 minute Bowie Quadrangle map. <br />In the Phase II and Phase III Final Bond Release, the Division is proposing to release all of the <br />remaining reclamation liability, a total of $42,065.00, for complete reclamation of the Blue <br />Ribbon Mine, as detailed in the Division's Proposed Decision and Findings of Compliance for <br />the Phase II and Phase III Final Bond Release. If the Division's proposed decision becomes <br />final, the Colorado Division of Reclamation, Mining and Safety will no longer have jurisdiction <br />over the reclaimed Blue Ribbon Mine. <br />A copy of the "Proposed Decision and Findings of Compliance" is on file for public inspection at <br />the Colorado Division of Reclamation, Mining and Safety, Room 215 Centennial Building, <br />1313 Sherman Street, Denver, Colorado 80203, at the Paonia Public Library, 2 P Street, Paonia, <br />CO 81428 and at the Delta County Clerk's Office, 5th & Palmer, Delta, CO 81416. <br />Any person with a valid legal interest which might be adversely affected by this proposed <br />decision may request a formal public hearing before the Mined Land Reclamation Board in <br />accordance with Rule 3.03.2(6). Requests for a public hearing must be received by the Division <br />within thirty days of the first publication in the Delta County Independent. The request must be <br />in writing and must state, with reasonable specificity, the reasons for requesting such a hearing. <br />All requests must be submitted to the Colorado Division of Reclamation, Mining and Safety, <br />1313 Sherman Street, Room 215, Denver, Colorado, 80203. If no hearing is requested within <br />those thirty days, the Division's decision will become final.
