On behalf of Honeywood Coal Company, Inc., following are <br />its responses to the DRMS' comments and concerns. <br />1. DRMS - Key components of the demonstration are derived from a vegetation study <br />performed by Cedar Creek Associates dated July 2009. The report is referenced in the <br />application, but the Division has not been provided with a copy. The cover letter that <br />accompanied the TR 10 application states that the operator intends to apply for a Phase <br />II bond release upon DRMS approval of the TR-10 soil loss demonstration. The Division <br />assumes that the Cedar Creek study will be included with the upcoming bond release <br />application. No further action is necessary at this time. <br />HON - No response required. <br />2. DRMS - Several tables and figures referenced on pages 2.05-8iv through 2.05-8vi have <br />not been included as attachments to this revision. It appears that these tables and <br />figures have been taken from the U.S.D.A. Agronomy Note #50 referenced in a previous <br />paragraph. Please modify Page 2.05-8iv to clearly state that the tables and figures <br />utilized in the USLE calculations are taken from the U.S.D.A. Technical Notes, <br />Agronomy Note #50. <br />HON- Page 2.05-8iv was amended as requested. <br />3. DRMS - An application for TR-09 (Pond B - Permanent Impoundment) was received by <br />the Division in July 2009. Certain adequacy issues raised by the Division for TR-09 will <br />not be able to be resolved prior to the spring of 2010. The application for TR-10 includes <br />versions of 2.05-8ii and 2.05-8iii as modified for the TR-09 submittal. Please modify <br />these pages to eliminate any text dependent upon approval of TR-09, using instead the <br />currently approved permit pages as the base document for TR-10. <br />HON - Amended pages 2.05-8 through 8iii are enclosed.
