III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br /> and Safety. The mine is a reclaimed surface mine. The weather was dry and mild. The gates on the <br /> mine access road and the Load out access road remain locked. The mine site is dry and vegetation is <br /> drying down <br /> Roads: The mine access road was dry with no problems accessing the remaining liability areas. The <br /> access road to the load out was dry and remains in good condition. A damaged(roll-over) vehicle, Isuzu <br /> trooper, was stored on the south side of the office building <br /> Records: As noted in the records section of this inspection, decision and findings for SL4, 2008 ARR, <br /> and 2008 Midterm review and findings, and second quarter 2009 pond inspection report need to be filed <br /> with the records at NWCC. KCC needs to keep files maintained at NWCC up to date. <br /> Hydrologic Balance: The Load Out pond held a shallow stagnant pool of water approximately 1 ft. <br /> below the discharge pipe. <br /> Revegetation: Canada thistle are present along the irrigation ditch near the load out gate. Some appear <br /> to have been sprayed with herbicide, and some of this patch is outside of the permit boundary. There are <br /> some small patches of Canada thistle on the south end of the reclaimed slope at the office area. Spot <br /> spraying of these patches is advised. <br /> Reclamation Success: Vegetation on the remaining liability areas of the mine(SE of Shop &N W of <br /> Pond B) is good. Vegetation is drying up for the season. No active erosion features or new gullies were <br /> encountered during the inspection. Other than the noted Canada thistle patches the vegetation is in good <br /> condition and noxious weeds were not prevalent. <br /> KCC will need to include information regarding weed control; timing, locations sprayed, and chemical <br /> used, in the annual reclamation report. <br /> Offsite support facilities: The gate remains locked. No problems noted with the load out pond or with <br /> the reclaimed load out area. <br /> Vegetation at the Load Out remains in good condition. <br /> 3 of 5 WHITE-File YELLOW-Operator PINK-Specialist <br />
