The
Division has determined that the filing constitutes a clarification of the application under Rule
1.8.1(4) rather than an actual amendment to the application. The Division has also determined that,
under Rule 1.6.6, the changes to the application are not so substantial as to require new notice to the
public. Therefore, the original timelines and decision date still apply. The decision date was
originally reported as 26 November 2009, which is Thanksgiving, so the revised date will be 30
November 2009.
Be advised of Rule 1.6.5(2) which requires that within ten (10) working days after the last
publication or as soon thereafter as proof has been obtained, you must mail proof of the publication
required by Rule 1.6.2(1)(d) to the Office.
Feel free to contact me with questions at 303-866-3567 x8108.
Sincerely,
David Bird
Environmental Protection Specialist
cc: Tony Waldron - DRMS
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
