The problems should be corrected by the dates given, or they will become possible <br />violations. The possible violations should be corrected by the dates given to reduce their severity when considered <br />by the Mined Land Reclamation Board. The inspector noted on the previous page should be notified of all <br />corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />CORRECTION <br />DATE <br />1. Tamarisk was growing along the pit wall in Cells Band C. Rule 3.1.10(6) states that methods 10/2 / 09 <br />of weed control shall be employed for all prohibited noxious weed species. <br />PB or PV: P_ <br />TOPIC(S): _BV <br />Corrective actions are to: <br />The Operator shall remove the Tamarisk from the site. The noxious weeds shall be removed <br />from the site on or before October 2, 2009 and proof of compliance must be submitted by <br />the same date. Proof of compliance may be in the form of photographs. <br />2. Groundwater is exposed in the pit and the Operator has failed to provide the Division with 10 /31 / 09 <br />a current copy of the Substitute Water Supply Plan and Well Permit. Rule 3.1.6(a) requires <br />Operators to be in compliance with applicable Colorado water laws and regulations <br />governing injury to existing water rights. <br />PB or PV: PR <br />TOPIC(S): AR <br />Corrective actions are to: - <br />The Operator shall provide the Division with current copy of the Substitute Water Supply Plan <br />and Well Permit from the Office of the State Engineer on or before October 31, 2009.
