III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br /> and Safety. Mr. JohnWeinman of Hydro-Environmental Solutions, Inc. provided access to the records <br /> located at the Hydro-Environmental solutions office. The site is an inactive load-out. The operation is <br /> approved to operate as a load-in facility too,but construction of off loading structures has not <br /> commenced. Weather was dry and overcast. <br /> Records: Records for the Load Out were checked in the Hydro-Environmental office. Records are <br /> complete and well maintained. The Air Emissions permit has expired(8/23/2008). Since no loading or <br /> unloading activity is occurring on the site,the operator will wait until the operation is planned to <br /> reactivate prior to obtaining a new emission permit. This is acceptable with DRMS. <br /> Hydrologic Balance: The load out site was dry. Ditches were in good repair and well vegetated. No <br /> problems were identified with the area ditches. The truck loop pond(Pond 1)was holding a pool of <br /> water below the discharge riser elevation. The headgate in the riser continues to weep just enough to wet <br /> the bottom of the riser pipe. Water was not passing through the discharge pipe so no discharge was <br /> occurring. Cattails are established around the perimeter of the pond. Willow bundles identified in the <br /> June inspection were no longer in place along the inslope of the truck loop pond. <br /> The rail loop pond(Pond 2)was completely dry. Vegetation has begun to take root on the rail loop <br /> combination spillway. This vegetation needs to be removed. The Division is concerned about roots <br /> breaking down the concrete. <br /> Spring ground water sampling was conducted May 13,2009. Analyses from May GW sampling were <br /> placed in the HGLO files. <br /> Support facilities: A small animal pen has been constructed as approved, and a horse, and 2 yaks were in <br /> the pasture NW of the office trailers. <br /> Revegetation: Fall weed control is needed. While no large patches of noxious species were encountered, <br /> small patches on Canada thistle were noted throughout the site. Occasional houndtongue rosettes were <br /> noted,and several individual whitetop plants have greened up on the rail loop embankment. An isolated <br /> patch of Leafy spurge was also identified along the rail line east of the Dry Creek Village entry road. <br /> Control and follow up is needed for the Leafy Spurge as well. <br /> There is a wet area on the East side of the rail line east of the Dry Creek Village entry road. There has <br /> been downcutting along the rail road ballast embankment. The area remains wet. The source of the <br /> water appears to be runoff from adjacent agricultural fields, however,this area should be monitored for <br /> weed establishment. <br /> Other than weed control management on the noxious weed patches, and clearing the rail loop spillway <br /> of vegetation,no problems were noted during the inspection. <br /> 3 of 5 WHITE-File YELLOW-Operator PINK-Specialist <br />
