MINE ID # OR PROSPECTING ID #: M-1989-1a7 <br />INSPECTION DATE: 111 712002 INSPECTOR=S INITIALS: 11F <br />OBSERVATIONS <br />This was a follow-up inspection of the Nyholt Pit; permit number M-1982-147. This site is located four miles <br />south west of the town of Brighton, Colorado in Adams County. I, Jared Ebert of the Colorado Division of <br />Reclamation, Mining and Safety conducted the inspection. Mr. Sean Frisch of Lafarge West, Inc. accompanied <br />me on the inspection. <br />The Division conducted a monitoring inspection at this site on September 26t", 2008. During that inspection <br />three problems were cited. This inspection was conducted in order to determine compliance with the corrective <br />actions cited in that inspection. The following is a list of the problems that were cited and the current status of <br />those problems based of this inspection (9-16-2009). <br />Problem#1: <br />- At several locations along the pit slopes of the north east lake and the south lake, erosion gullies and ruts have <br />formed. This is a problem at this time for failure to protect the affected land from erosion pursuant to C.R.S. <br />34-32.5-116 (4) 0). <br />-Corrective Action Required: Please provide photo documentation to the Division that the various <br />erosion gullies and ruts have been controlled and that the pit slopes have been reconstructed and <br />stabilized. <br />Current Status: The operator did not supply the proper photo documentation as requested by the Division. <br />However, based off this inspection, Lafarge has repaired the ruts and gullies so this problem is considered <br />resolved at this time. <br />Problem #2: <br />- On the western pit slope of the south lake, the slope was found to be steeper than a 3:1 horizontal to vertical <br />ratio as it is specified in the approved reclamation plan. This is a problem at this time for failure of the operator <br />to perform the reclamation prescribed by the reclamation plan. This is pursuant to C.R.S. 34-32.5-116 (1) <br />-Corrective Action Required: The pit slope on the western side of the south lake will need to be <br />backfilled with material to form the 3:1 horizontal to vertical ratio as it is prescribed in the approved <br />reclamation plan. Please submit a letter of notice to the Division when the pit slope has been <br />constructed and the Division will conduct a follow-up inspection for the corrective action. <br />-Current Status: Originally, this problem was noted to have occurred at the wrong lake. However, the slopes <br />were re-inspected and several slopes are steeper that what is approved in the current reclamation plan. A <br />portion of the north west lake's northern pit slopes was measured to be set at a 2.5:1 horizontal to vertical ratio. <br />Also, a portion of the North East lakes pit slopes were found to be at a 2:1 ratio. These pit slopes will need to <br />be repaired and graded to the approved 3:1 horizontal to vertical ratio. This issue is cited as a problem at the <br />end of this report and will required immediate corrective action by the operator. <br />Problem#3: <br />-Russian olive and Tamarisk Trees have volunteered into the site and are spreading throughout the affected <br />area. This is a problem at this time for failure to employ weed control for weed species that threaten the <br />development of the desired vegetation. This is pursuant to Rule 3.1.10 (6). <br />-Corrective Action Required: Please remove the Russian olive trees and the Tamarisk trees in the <br />affected area. Please submit a letter of notice to the Division when these tree species have been <br />2
