Nonetheless, our CDPS permits have always <br />allowed an exemption for settleable solids for discharges resulting from a greater than 10- yr 24-hour <br />storm event. I'll reference and quote from our CDPS permit in the "official" response. The peak settleable concentrations in the 10-year storm SEDCAD runs for ponds MB-3 and M13-5E <br />exceed the 0.5 ml/1 limitation typically found in West Elk's CDPS permits. Please explain how these <br />calculated peak settleable concentrations in SEDCAD demonstrate the discharges will comply with the <br />0.5 ml/1 discharge limitation?
