Tom,
When Ryan and I reviewed the SedCAD, we found that MB-3 showed 0.0 ml/I for peak settleable
solids for both the 10-year and 25-yr storm events. Nonetheless, our CDPS permits have always
allowed an exemption for settleable solids for discharges resulting from a greater than 10- yr 24-hour
storm event. I'll reference and quote from our CDPS permit in the "official" response. The M13-5E
ponds each hold more than the 10-yr storm volume so we'll ask Tetra-Tech to check that number.

The corrected comment 2 for TR-119 is shown below.
2. The peak settleable concentrations in the 10-year storm SEDCAD runs for ponds MB-3 and M13-5E
exceed the 0.5 ml/1 limitation typically found in West Elk's CDPS permits. Please explain how these
calculated peak settleable concentrations in SEDCAD demonstrate the discharges will comply with the
0.5 ml/1 discharge limitation? Is a storm exemption assumed?
