C Mo 007
Kaldenbach, Tom
From: Welt, Kathy [KWelt@archcoal.com]
Sent: Thursday, September 10, 2009 12:58 PM
To: Johnston, Carl
Cc: Kaldenbach, Tom
Subject: RE: Windy Gap Calculations per TR-118 and TR-119
Thanks for the clarification Carl. So am I correct that since the recalculated depletion is less than
what we'd calculated and had USFWS consultation on years ago, this revision won't require a new
consultation?
Xathy Welt,
Environmental Engineer III
Mountain Coal Company, LLC
West Elk Mine
P.O. Whenever there is an increase in water depletions
due to mining activities beyond that previously addressed in a formal section 7 consultation, formal section 7
consultation must be reinitiated regardless of how small the increase may be.
For projects that began depleting water on or after January 21, 1988, and the depletion is greater than 100
acre-feet per year, the project proponent must pay a onetime fee, based on the average annual depletion of the project,
in order to receive Endangered Species Act compliance under the Recovery Program. The onetime fee is adjusted
annually for inflation, and will vary from year to year.
Carl R. Johnston
Natural Resource Specialist
OSMRE/WR/FOB/NWB
P.O.
