Per our water rights adjudicated in November 2006, we have the right to store more than 900 of and
pump at a rate of more than 2,000 gpm of non-tributary water from the West Elk Mine. So we're
legally OK to use the rather minimal numbers that I'd used in the calculation.

You are correct assuming that your depletion estimate is correct and that all mine inflows are from
non-contributory sources. The last consultation was in May 2005, was for 84.2 ac/ft/yr.
