The responses are <br />provided in the same order as presented in your letters. <br />September 03, 2009 letter: <br />1. Attached are the cover page and pages 1, 5 and 24 of Exhibit 51 (Lower Refuse Pile designs) that have <br />been revised to include discussions on the coal preparation plant (CPP), lab building and coal stockpiles <br />that will be constructed on top of the LRP. Reference to the stability analysis completed on the LRP <br />with the new building loads was also added. The stability analysis and addendum (per below) will be <br />added at the end of Exhibit 51. <br />2. Exhibit 67 (Windy Gap Process) was revised and submitted to you and Carl Johnston of OSMRE via e- <br />mail on September 90'. Carl has since responded that no consultation with the USFWS will be required. <br />3. Revised permit text pages correcting and incorporating the revisions approved per MR-353 and MR- <br />. <br />354, as well as the proposed revisions per TR-118 and TR-119 were e-mailed to you on September 140' <br />4. See response #4 above. <br />5. The reclamation cost estimate prepared by the Division on September 100' is acceptable. <br />September 14, 2009 letter: <br />6. A P.E. signed and stamped addendum to the LRP/ CPP stability analysis of September 8`h, utilizing the <br />parameters suggested by the CDRMS Engineer, Marcia Talvitie, was submitted to the CDRMS <br />yesterday. Marcia indicated by e-mail yesterday that the stability analysis with the addendum was <br />acceptable. The analysis and addendum has been referenced in Exhibit 51 and will be added at the end. <br />7.
