Whenever there is an increase in water depletions <br />due to mining activities beyond that previously addressed in a formal section 7 consultation, formal section 7 <br />consultation must be reinitiated regardless of how small the increase may be. <br />For projects that began depleting water on or after January 21, 1988, and the depletion is greater than 100 <br />acre-feet per year, the project proponent must pay a onetime fee, based on the average annual depletion of the project, <br />in order to receive Endangered Species Act compliance under the Recovery Program.
