The <br />update also includes consideration of the pond MB-5E and the Coal Preparation plant water usages <br />per TRs 118 and 119. Based on these more current and accurate water volume figures, as well as <br />Mountain Coal's maximum projected coal production, the conservative net depletion was calculated <br />to be 47.1 acre-feet per year, reduced from 84.2 acre-feet per year. It is my understanding that with <br />the net depletion remaining below 100 acre-feet per year that no consultation with the USFWS will be <br />required.
