The bond release application was found
complete by this Division on September 21, 2009. In Surety Release No. 4 (SL-4), Bear Coal Company is applying for a
partial Phase I Bond Release at the Bear No. 3 Mine. The partial Phase I Bond Release request is for structural demolition
and removal, as well as for backfilling and grading of 7.5 acres of disturbed land. The west side portal area reclamation is
not being considered for bond release at this time. The sediment control system will remain in place to treat disturbed area
runoff. The current reclamation liability is $279,224.00, which is the amount of bond that the Division holds for
reclamation. The Bear Coal Company is seeking a release of $167,000.00.
The Division will be conducting the bond release inspection of the Bear No. 3 Mine on Tuesday, November 3, 2009 at 9:00
am. The purpose of the inspection will be to evaluate the reclamation at the site. Rule 3.03.2(2) of the Rules and Regulations
of the Colorado Mined Land Reclamation Board for Coal Mining requires that you be notified prior to the inspection, so
that you may attend the inspection. If you wish to attend the inspection, please contact me for specific details.
