Sherman
Executive Director
Dick Wolfe, P.E.
Director
DATE: September 22, 2009
TO/,*/ Wallace H. Erickson, Senior Environmental Protection Specialist
CC: Division 7 Office; District 29 Water Commissioner
FROM: Heidi Frey, P.E. 1F
RE: Mask Ranch Gravel Pit, File No. M-2002-087 ?
Operator: Mask, LLC,
Contact: Dennis Walker
Section 25, Twp 35 N, Rng 2 W, 6th P.M., Archuleta County
CONDITIONS FOR APPROVAL
? The proposed operation does not anticipate exposing groundwater. Therefore, exposure of ground
water must not occur during or after mining operations.
? The proposed operation will consume ground water by: ? evaporation, ? dust control, ?
reclamation, ? water removed in the mined product, ? processing, ? other:.
Prior to initiation of these uses of ground water, the applicant will need to obtain either a gravel pit
or other type of well permit, as applicable.
® Prior to approving a well permit, the applicant must conduct a field inspection of the site and
document the locations of all wells within 600 feet of the permit area. The applicant must then
obtain a waiver of objection from all well owners with wells within 600 feet of the permit area or
request a hearing before the State Engineer.
® Other: Comments were provided by this office on September 12, 2002 stating that a well permit was
required should ground water be exposed. This was never done.
COMMENTS: It appears that this mining area may contain both surface water and ground water.
Comments in the application indicate that the land owner has plenty of water rights for use within the
operation. Review of court decrees show that they do not have water storage rights. If they intend to use
any surface water rights to fill the ponds, they will need to go to water court for a change of water rights.
CC: Rege Leach, Division Engineer
Pete Kasper, Water Commissioner
SEP u ?
Office of the State Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303-866-3581 • Fax: 303-866-3589
www.water.state.coms
VII/
