Reclamation will <br />run concurrent with mining and native species of grass will be planted on the reclaimed area. ?A soil and <br />vegetation study shall be obtained to ensure the success of any reclamation. ?A Mined Land Reclamation <br />Board permit shall be provided prior to any issuance of a Special Use Permit. <br />Another component of the Master Plan is the goal of providing adequate infrastructure. The proposed use <br />would provide material for the maintenance of County roads that must serve an increasing population of tourists <br />and County residents. Staff feels that the proposed project will be a benefit in order to supply gravel for County <br />use. <br />COMPLIANCE WITH GRAND COUNTY ZONING REGULATIONS <br />This property is located within the Forestry and Open zone district. Gravel pit operations are regulated under <br />Section XI, Uses Permitted by Special Review, Subsection 11.8 (3): <br />(a) Truck traffic to and from such uses shall not create hazards in developed Estate, Residential, <br />Accommodations and Tourist areas; <br />The entire vicinity of this gravel pit is in the Forestry and Open zone district, and is not likely to cause any <br />hazards to the public. The adjacent properties to the proposed gravel pit are all zoned Forestry and Open as <br />well. <br />However, because of the multiple recreational uses in the vicinity, ?the Applicant shall obey all posted traffic <br />speeds and be mindful of horseback riders. <br />?The Applicant shall post proper signage to alert traffic on County Road 3 that trucks will be entering the <br />roadway. ?Dust control on the access road between County Road 3 and the pit entrance shall be provided as <br />needed during periods of hauling. <br />(b) Truck traffic to and from such uses shall not unduly damage public roads; <br />Truck traffic will be accessing County Road 3 off of US Hwy 40. ?If any damage to the County roads occur <br />from truck traffic to and from the gravel pit, the Applicant shall be responsible for all repairs incurred by <br />County owned trucks. <br />(c) A satisfactory general rehabilitation plan for the land shall be submitted prior to the start of operations and <br />implemented thereafter; <br />?A soils and vegetation study shall be conducted to ensure the success of reclamation when the mining is <br />complete. ?All requirements addressed by the Soil Conservation Service response shall be listed and required <br />as a part of the Special Use Permit. A Reclamation Plan will be included in the application for a Regular <br />Operations 112 Permit under the Colorado Mined Land Reclamation Act. The 112 Permit will include <br />provisions regarding reclamation requirements. <br />Reclamation will run concurrent with the mining to limit the amount of area disturbed. Any topsoil or growth <br />medium will be retained to re-spread over disturbed areas to make a seedbed once mining is done and will be <br />planted with natural grasses and plants. The Applicant has contracted with the Department of Natural <br />Resources to perform spraying of noxious weeds within the pit area on an annual basis. <br />(d) Quarry, sand and gravel operations shall require a well permit issued by the Office of the State Engineer if <br />groundwater is exposed or water is required for operations; <br />It is not expected that ground water will be exposed in this operation and no water is required for the operation <br />of the pit. ?If water is needed in pit operations in the future, adequate proof of water shall be provided. <br />?There will be disturbance of more than 5 (five) acres, therefore a Stormwater Management Permit will need to <br />be obtained from the State Department of Health and Environment. <br />(e) A CDOT access permit is acquired, if necessary; <br />The proposed pit will be located off of County Road 3, and therefore a CDOT access permit is not required. <br />PLANNING COMMISSION RECOMMENDATION
