16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of
this time, Trapper Mining, Inc. is current in the payment of reclamation fees required by 30
CFR Chapter VII, subchapter R. (2.07.6(2)(0)).
Part B - Findings required by Rule 4
The following findings and specific approvals are required by Rule 4.
1. Roads - Rule 4.03
A. Haul Roads
Haul roads are discussed under Section 3.7.2, Vol. III of the permit application.
The Division has previously approved a temporary ford of an ephemeral or
intermittent stream having a watershed of at least one square mile during the
construction period, being that it will not alter normal water flow, contribute
sediment, or adversely affect fish or wildlife. All road construction occurs
upstream of adequate sediment control facilities. The approved drainages for
this activity are Coyote, Johnson, No Name, and East Pyeatt. (4.03.1(2)(c)).
B. Access Roads
Access roads are discussed under Section 3.7.3, Vol. III of the permit application.
The Division previously approved specific fords of ephemeral streams in
watersheds of at least one square mile because they will not seriously alter
normal water flow, contribute to sediment load, or cause adverse affects to
fish or wildlife. The fords may occur in the Coyote, Johnson, No Name, and
East Pyeatt drainages. Adequate sediment control facilities exist downstream
of all fords except the West Pyeatt ford, which was found to not need
sediment control. (4.03.2(2)(c)).
II. Support Facilities - Rule 4.04
Support facilities are discussed under Section 3.8, Vol. III of the permit application.
A. Construction of support facilities will not result in damage, destruction, or
disruption of oil, gas, or water wells or pipelines, coal slurry pipelines,
railroads, or utility lines which pass over, under, or through the permit area.
Utility lines and a gas line pass through the permit area but are affected only
by the pit areas and not by any support facilities. No utility lines require
relocation as a result of PR-06. Written approval from the owner of the
affected facilities has been submitted. The Division has previously approved
the activities (4.04(6)).
Trapper Mine 23 September 21, 2009
