LaSalle Pit Adequacy Response <br />Rule 1.6.2(e): Rule 1.6.2(e) requires a mailing or personal delivery of notice to all <br />landowners within 200 feet. This has been met by the certified mail receipts. <br />Rule 6.4.3(a): Map C-1 has been modified to more clearly show the owners of adjacent <br />lands. <br />Rule 6.4.3(d): The permit boundary contains all affected lands. <br />Rule 6.4.4: <br />1. A minimum of two feet over cover will be placed over any exposed Mancos Shale <br />or groundwater. <br />2. All berms will be constructed from on site material, mostly topsoil, and seeded <br />with the reclamation seed mix upon construction. <br />3. The direction for mining will be, in general, east to west. Arrows indicating this <br />have been added to Maps C-2 & C-3. <br />4. Details regarding the asphalt plant have been added to Exhibit D. <br />5. Table D-3 has been updated with details of the secondary containment for all <br />petroleum products to be stored on-site. <br />6. All mining on the LaSalle Pit will take place to a final pit slope of 3H:1 V. The <br />crest of the final pit slope will be at the base of the topsoil berm running along the <br />west and south sides of the pit, as shown on Map C-3. <br />7. Stormwater will be contained within the mine pit throughout the mine life. There <br />will be no discharge, so no retention pond will be constructed. <br />Rule 6.4.5(2)(a): A 6 inch layer of gravel will be placed on the floor of the industrial <br />yard. <br />Rule 3.1.6(1)(b)(c): It has been determined that no wetlands delineation is necessary for <br />this site, and therefore the USACOE does not have jurisdiction. A standard letter from the <br />USACOE was received informing both the state and the applicant of the responsibility of <br />the applicant to not fill or damage waters or wetlands of the United States. A copy of the <br />letter is attached. <br />Rule 3.1.6(3): All runoff will be contained in the LaSalle site both during and after <br />mining via containment berms. <br />Rule 3.1.7: See Rule 6.4.4(1) response. <br />Rule 3.1.10(3): No livestock will be allowed to graze upon any areas of the site. <br />Rule 3.1.10(8): See Rule 6.4.5(2)(a) response. <br />Rule 3.1.11: None of the original structures will remain, but facilities pertaining to the <br />end of mine land use of an industrial yard will be left in place.
