Box 859, Peenesburg, CO 80643 <br />REQUEST: Amend a Use by Special Review permit (surface coal mining and ash <br />disposal) <br />LEGAL DESCRIPTION: Part of Sections 25, 26, and 36, all in T31i, R64W of the <br />6th P.M., Weld County, Colorado <br />LOCATION: Approximately 4 miles north of Keenesburg on Weld County Road 59 <br />THE DEPARTMENT OF PLANNING SERVICES STAFF RECOMMENDS THAT THIS REQUEST BE <br />APPROVED FOR THE FOLLOWING REASONS: <br />1. The submitted materials are in compliance with application <br />requirements of Section 24.7 of the Weld County Zoning Ordinance. <br />2. It is the opinion of the Department of Planning Services staff <br />that the applicant has shown compliance with Section 24.3 of the <br />Weld County Zoning Ordinance as follows: <br />The proposal is consistent with the Weld County <br />,. Comprehensive Plan in that extraction of mineral <br />resources and disposal sites are allowed as long as they <br />are preserving prime agricultural farm land; <br />- Open-pit mining and solid waste disposal sites are <br />provided for as uses by special review in the <br />Agricultural zone; <br />- The propoped uses will be compatible with the existing <br />surrounding land-uses; <br />- The proposal will be compatible with future development <br />of the surrounding areas as prof-eted by the Feld County <br />Comprehensive Plan; <br />- No overlay districts affect the site. <br />- The Use by Special Review Development Standards will <br />-provide adequate protection of the health, safety and <br />welfare of the neighborhood and County. <br />This recommendation is based, in part, upon a review of the application <br />submitted by the applicant, other relevant information regarding the request <br />and the responses of the referral entities which have reviewed this request.
