Cattany <br />Division Director <br />Natural Resource Trustee <br />On August 12, 2009, the Colorado Mined Land Reclamation Board (the Board) approved a <br />t from Wildcat Mining Corporation (Wildcat) for extension of the deadline whereby Wildcat <br />was to have obtained the appropriate permit to incorporate the new access road into the permit <br />and addressed by the reclamation plan and warranties. The Board extended the deadline to <br />November 13', 2009. <br />Therefore, the Formal Board Hearing previously scheduled for September 10, 2009, and Pre- <br />hearing Conference previously scheduled for August 27, 2009, has been rescheduled. <br />The Formal Board Hearing has been rescheduled for the November 12 and 13, 2009 Board <br />meeting, which will occur in Room 318 of the Centennial Building at 1313 Sherman Street, <br />Denver, Colorado, beginning at 9:00 a.m. on both days or as soon thereafter as the matter can be <br />considered. Parties and interested persons will have the opportunity to be heard. During the <br />hearing the Board will consider the application with objections and may decide to approve, <br />approve with conditions or deny the application. <br />The Pre-hearing Conference has been rescheduled for October 26, 2009 and will occur in the <br />Anasazi Room (County Commissioners Room) of the La Plata County Government Building <br />located at 1060 East Second Avenue, Durango, Colorado, beginning at 3:00 p.m.. The Board has <br />appointed Ms. Sandra Brown to preside as Conference Officer for the Pre.-hearing Conference. <br />The Pre-hearing Conference will beheld to describe the Division's review process, to explain the <br />rights and responsibilities of parties, to discuss and resolve issues to the extent possible, to <br />describe the Board Hearing processes, to propose a list of issues under the Board's jurisdiction, <br />to simplify that list, and to identify parties. Lists of any exhibits and witnesses the parties intend to <br />present at the. Formal Board Hearing must be exchanged between the parties at the Pre-hearing <br />Conference in accordance with the requirements of Rule 2.6(2). Failure to.participate in the Pre- <br />hearing Conference will result in the loss of your party status. <br />After the conference the Pre-hearing Officer shall prepare a proposed Pre-hearing Order. The <br />proposed Pre-hearing Order will be made available to all parties prior to the Formal Board <br />Hearing. The proposed Pre-hearing Order will contain a list of the parties, provide a
