• Please describe what measures will be taken to prevent oxidation of the Mancos <br />Shale that lies immediately under the deposit of interest. <br />RESPONSE: Item (5) was added to typical sequence of operations. Mancos shale will <br />be protected from oxidation by keeping a minimum 1-foot cover over the layer at all <br />times. <br />3. EXHIBIT E - Reclamation Plan (Rule 6.4.5): <br />• Throughout the application the proposed post mine land use is inconsistent. <br />Please clarify what the intended post mine land use is and submit corrections to <br />the application for the inconsistencies noted in the application. <br />RESPONSE: Post mine land use has been clarified to create two-ponds for a Recreation <br />Facility. <br />• Section Part 2(c) 3.1.3 states that "final reclamation for the 32.5 acre area is <br />anticipated to require 6 months to complete." 32.5 acres is more acreage than <br />the 30.25 acres stated on page 1 of the application form. Please clarify what the <br />total acreage is. Clarify what the affected and total permit acreages are for the <br />proposed operation. If more than 30.25 acres is required an amendment to the <br />application will be required to incorporate any new acreage into the application. <br />RESPONSE: This was a typo the area is 30.25 acres. Revised in this section <br />accordingly <br />• Section Part 2(c) 3.1.6 states that a settlement pond will be located near the <br />northwest corner of the project site. All other parts of the application state the <br />dewatering ponds will be located in the southwest corner of each phase. Please <br />clarify exactly where the ponds will be located and locate them on the mine plan <br />map. <br />RESPONSE: The ponds will be located near the southwest portion of each phase. The <br />exact location may be adjusted to the hydrologic low point. Revised accordingly. <br />• Section Part 2(c) 3.1.9 states that 2-6 inches of topsoil will be removed and <br />stockpiled. This amount is inconsistent with the figures stated in the mine plan <br />which states that 6-12 inches of topsoil will be salvaged and stockpiled. Please <br />clarify what amount of topsoil is the correct amount. <br />RESPONSE: Revised in this section. 2-6 inches of topsoil is anticipated. <br />4. EXHIBIT F - Reclamation Map (Rule 6.4.6): <br />• Show the configuration of the two proposed mine phases and clearly label the <br />permit boundary and be sure the map has a scale. <br />RESPONSE: Revised for clarity. <br />• State the average thickness of replaced overburden by reclamation area or <br />phase <br />RESPONSE: Average thickness will be 6-inches for replaced overburden. Clarified in <br />the second paragraph in this section. <br />5. EXHIBIT L - Reclamation Costs (Rule 6.4.12): <br />• This section states that the applicant has existing stockpiled material stored at <br />the site that will be used for the mining operations. Please locate the stockpiled <br />material on the pre-existing conditions map. <br />RESPONSE: There are no existing stockpiled materials stored on the site. Typo was <br />revised. There are berms surrounding the abandoned lagoon ponds which are shown <br />with existing contours on the pre-existing conditions map. <br />• Exhibit L states that 44.6 acres will be backfilled and compacted. The application <br />is only for 30.25 acres. Please explain the differences in acreage. <br />RESPONSE: This was an error, no reclamation or disturbance will occur outside the <br />mining permit area. Only 30.25 acres will be mined.
