<br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34,
<br />Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on April 2, 2008, an
<br />application to revise coal mining operations at the Deserado Mine was considered complete for the
<br />purposes of filing. All review and comment periods as provided in the Act and the Regulations initiate
<br />from this date of filing.
<br />The Deserado Mine has submitted a permit revision to increase it's permit boundary by 760 acres. The
<br />mine is also proposing a change to it's mining plan to incorporate the additional acreage. No new surface
<br />disturbances are proposed.
<br />The underground coal mining operation is on land located approximately 7 miles Northeast of Rangely,
<br />Colorado. The permit area is further described as follows:
<br />Portions of Sections 1, 2, 3, 4, 10, 11, and 12, T2N, R101 W, 6th PM, all in Rio Blanco County; Portions
<br />of Sections 21, 23, 25, 26, 27, 28, 30, 31, 34, 35, and 36, T3N, R101 W, 6th PM; All of Sections 22, 29,
<br />32, and 33, T3N, R101 W, 6th PM, all in Rio Blanco County.
<br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Rangely NE and
<br />Cactus Reservoir.
<br />The DRMS requests written verification regarding Federal mining leases and/or federal surface access
<br />approval. Blue Mountain Energy, has referenced the Federal mining lease(s) and/or Federal Surface
<br />access agreement(s) COC-8424 in this application as a document upon which they base their legal right to
<br />enter. Please verify that the lease(s) and/or agreement(s) has/have been issued and that final BLM/federal
<br />agency lease/agreement approval has been granted. If the lease/agreement application is pending, please
<br />notify DRMS as to the status of the lease/agreement review and when a decision is anticipated.
