Cattany <br />Division Director <br />Natural Resource Trustee <br />RE: Greeleyr35th Avenue Mine, DRMS File# M-1977-036, Adequacy Review #1, <br />Amendment 01 <br />Dear Mrs. Hora, <br />The Division of Reclamation, Mining and Safety has completed its preliminary adequacy <br />review of your 112 construction materials reclamation permit amendment application. <br />The application was received on July 6th, 2009 and called complete for review on July <br />19th, 2009. An objection has been received in regards to this application on August 18th, <br />2009. This objection was filed within the public comment period, thus this application <br />will be considered for approval or denial by the Mined Land Reclamation Board at the <br />November 12th and 13th Board Hearing. The Division is required to make a <br />recommendation for approval or denial of this application on October 15th, 2009. Please <br />be advised that if you are unable to satisfactorily address any concerns identified in this <br />review before October 15th, 2009, it will be your responsibility to request an extension of <br />the review period. If there are outstanding issues that have not been adequately <br />addressed prior to the end of the review period, and no extension has been requested, the <br />Division will recommend denying this application. <br />The review consisted of comparing the application content with specific requirements of <br />Rule 3, 6.1, 6.2, 6.4 and 6.5 of the Minerals Rules and Regulations of the Colorado <br />Mined Land Reclamation Board for the Extraction of Construction Materials.
