It is also updated for mid-term
reviews and permit revisions. This findings document documents the reevaluation and update of
previous findings as necessary to reflect changes which have occurred during the past permit
term (5 November 2002 to present) Any stipulations from the original permit and findings
document or subsequent revisions that have been resolved have been removed from this
document. There are currently five stipulations that are attached to and remain in effect at the
Colowyo Mine. No new stipulations are being added as a result of Permit Renewal 05.
Section A - Findings Required by Rule 2.07.6(2)
1. Accuracy and Completeness. The Application is accurate and complete, and in compliance
with all requirements of the Act and these rules. .
II. Feasibility. Based on information contained in the Application and other information available
to the Division, the Division finds that surface coal mining and reclamation can be feasibly
accomplished at the Colowyo Mine [in compliance with Rule 2.07.6(2)(b)].
III. Cumulative Impacts. The assessment of the probable cumulative impacts of all anticipated
coal mining in the general area on the hydrologic balance, as described in Rule 2.05.6(3), has
been made by the Division. This assessment, entitled "Yampa River Cumulative Hydrologic
Impact Statement," was completed on 30 April 2007 and is available for inspection at the offices
of the Division.
