1 <br />6. The reference areas will be utilized to determine revegetation success in a manner which the <br />Division finds acceptable [Rule 4.15.7(4)]. <br />XIV. Post-mining Land Use - Rule 4.16 <br />The Permit was found to be in compliance of Rule 4.16. <br />Site description and background land use information is found in Section 2.04.3 and on Maps 17 <br />and 17A of the Permit. Specific objectives of the post-mining land use plan are described in <br />Sections 2.05.5 and 4.16 of the Permit. <br />The Applicant plans to return the disturbed area to rangeland capable of supporting the historic <br />uses of livestock gm7ino, and wildlife hnhitat Cneci_fi_rally the OnPrntnr ndanc to remnvp anrd <br />narrow the existing haul road (B) and leave light use roads and stock tanks subject to Division <br />approval. These land uses are consistent and compatible with adjacent land uses. The Bureau of <br />Land Management, the agency responsible for managing the federal lands portion of the affected <br />area, has reviewed the plan and stated by letter that the post-mining uses for rangeland and <br />wildlife are acceptable (Findings, 1992). <br />No specific findings required by Rule 4.16 are applicable. <br />XV. Air Resource Protection - Rule 4.17 <br />The Permit was found to comply with Rule 4.17. The mine operates under a valid air resource <br />protection permit issued by the Colorado Department of Public Health and Environment. <br />XVI. Protection of Fish, Wildlife and Related Environmental Factors - Rule 4.18 <br />The Permit was found to comply with Rule 4.18 <br />Descriptions of fish and wildlife resources are contained in Sections 2.04.11 of the Permit. The <br />fish and wildlife portion of the reclamation plan starts on page 2.05.65 of the Permit. Other <br />wildlife-related information is contained in Section 4.18, Exhibit 11 and Maps 13, 13A, 14, 14A, <br />15 and 15A of the permit Application. <br />With the expansion of mining into the South Taylor area, the DOW expressed concerns <br />regarding the re-establishment of a mountain shrub and aspen communities, varying topsoil <br />replacement depths to increase diversity and developing snow holding sites in a letter dated 5 <br />July 2007. These concerns were minimally addressed in Technical Revision 72 which was <br />approved on 24 June 2009.
