NO LATER THAN 1 SEPTEMBER 2009 THE OPERATOR WILL SUBMIT A COMPLETE <br />TECHNICAL REVISION APPLICATION PROVIDING A DETAILED PLAN FOR <br />VARIABLE THICKNESS TOPSOIL REPLACEMENT FOR THE WEST PIT AND SOUTH <br />TAYLOR PIT. THE PLAN SHOULD INCLUDE A NARRATIVE AND MAPPING THAT <br />DELINEATES TOPSOIL REPLACEMENT ZONES OF SPECIFIED THICKNESS RANGE <br />AND MINIMUM AVERAGE THICKNESS. THE PLAN WILL CONTAIN DETAILS AND <br />COMMITMENTS ADEQUATE TO DEMONSTRATE COMPLIANCE WITH RULE <br />4.06.4(2)(A) AND ADEQUATE TO ENSURE THAT ECOLOGICALLY SIGNIFICANT <br />VARIATION IN SOIL THICKNESS WILL BE ACHIEVED (INCLUDING A <br />COMMITMENT TO APPROPRIATE ANNUAL MONITORING AND REPORTING). <br />THE MAPPING AND NARRATIVE WILL CLARIFY THE APPROXIMATE EXTENT AND <br />GENERAL LOCATION OF ENHANCEMENT PROCEDURES MENTIONED IN THE <br />TPCTJATTPAT T RVTCTlIAT'77 ATA7?D TTATU TAT(-TTTTITT?T(1 QnTT RRATfTC RYTRATCTATP QnTT <br />1 L<Jl11 •1VL 1L 1\LYIVLVI\ 1L 1\L 11\1 111Y L, 11\ - I <br />?LV "VXL 1.JL1?11V, L..JL11 L1\V1YL VV1L <br />ROUGHENING AND SNOW FENCE INSTALLATION. <br />RECLAMATION OPERATIONS, INCLUDING TOPSOILING AND REVEGETATION, <br />WILL PROCEED IN 2009, WHETHER OR NOT A VARIABLE TOPSOIL REPLACEMENT <br />PLAN IS APPROVED. UNLESS AND UNTIL A VARIABLE THICKNESS TOPSOIL <br />REPLACEMENT PLAN IS APPROVED BY THE DIVISION, TOPSOIL REPLACEMENT <br />WILL ACHIEVE AN APPROXIMATE UNIFORM THICKNESS OF 8 INCHES <br />THROUGHOUT THE POST-2008 PORTIONS OF THE ORIGINAL PERMIT AREA, AND <br />19.5 INCHES THROUGHOUT THE SOUTH TAYLOR RECLAMATION AREA, AS <br />CURRENTLY APPROVED. <br />D. Specific Findings Required by Rule 4.06 <br />1. The Division approved a waiver of the requirement for clearing of vegetation cover prior to <br />topsoil removal. The Applicant has demonstrated that inclusion of vegetation cover in salvaged <br />topsoil is necessary or desirable to ensure soil productivity consistent with the post-mining land <br />use [Rule 4.06.2(1)]. <br />2. The Division granted a variance from topsoil removal in accordance with Rule 4.06.2(2)(a). <br />Areas which may qualify for variance are: Areas where light traffic does not destroy existing <br />vegetation, areas where removal would result in needless damage to soil characteristics, steep <br />slopes of minimum topsoil depths, steep slopes hazardous for equipment operations and areas of <br />construction of small structures such as power poles, signs or fence lines. <br />V. Sealing of Drilled Holes and Underground Openings - Rule 4.07 <br />The Permit is found to be in compliance with Rule 4.07. Each exploration hole, other bore hole <br />or other exposed opening constructed or encountered during mining will be cased, sealed or <br />otherwise managed (some holes are mined through) according to the requirements of 4.07. <br />Proposed Decision and Findings of Compliance 14 September 2009 <br />Permit Renewal 05 Page 49
