asphalt (Permit, page 4.03-1). Haul Road B was once designated as the Access Road (Permit, <br />page 4.03-1). This Haul Road B is an asphalt paved road from State Highway 13 to the main haul <br />road. The old mine administrative office building is located along this Haul Road B. Both haul <br />roads meet all design and construction requirements of the haul road regulations. The <br />reclamation plan calls for the removal of the pavement, reduction of the road width to 12 feet, <br />reduction of side slopes to 4:1 and revegetation of the sideslopes for Haul Road B [Permit, page <br />2.05-61; Rule 4.03.1(1)(f)(ii)]. Haul Road A is to be removed and reclaimed. One new haul road <br />is proposed with Technical Revision 76 (still under consideration by the Division). This haul <br />road will connect Haul Road A and the active mining operations in the West Pit and South <br />Taylor Pit. This haul road will be partially in-pit and will run along the west side of the West Pit <br />along the Taylor Draw. This haul road is proposed for removal upon completion of mining and <br />reclamation activities. <br />B. Access Road - Rule 4.03.2. The Sturgeon Road, from Colorado Highway 13 to the Section 21 <br />Pond and the Section 28 Pond, is designated as an access road. This road has been designed and <br />constructed in accordance with Rule 4.03.2. The road is surfaced with gravel and has Missouri <br />crossings and ditches to control surface runoff. <br />C. Light Use Roads - Rule 4.03.3. Light use roads, some of which were pre-mining trails, are <br />used infrequently to monitor sedimentation ponds or other facilities. These roads meet the design <br />requirements of the Rules. Some light use roads will be retained following reclamation as "ranch <br />roads" to approximate roads that were in the area before mining (Permit, page 2.05-61). <br />D. In-Pit Haul Roads. As presented in Rule 1.04(l 11), the definition of "road" does not include <br />roadways within the immediate mining pit area. This includes the haul roads in the East Pit, <br />West Pit, Section 16 Pit and South Taylor Pit. There is also a new haul road that will run from <br />the facilities area, through the West Pit and along the Taylor Draw. The portion of the road up to <br />the Taylor Draw is considered an in-pit road. The portion of the road in Taylor draw is not an in- <br />pit road and, as such, must comply with Rule 4.03.1. This road will be the main haul road for the <br />South Taylor Pit. The road is proposed for removal upon completion of mining and reclamation <br />activities. <br />II. Support Facilities - Rule 4.04 <br />The Permit is found to be in compliance with the requirements of Rule 4.04. Information on <br />mine support facilities is found in Section 4.04 of the Permit in both Volumes I and XII. The <br />Division finds that support facilities are designed, constructed, maintained, and their planned <br />demolition and (area) reclamation are sufficient, to prevent damage to fish, wildlife, and related <br />environmental damages and prevent additional contributions of suspended solids to streamflow <br />or runoff outside the permit area [Rule 4.04(1)]; control and minimize diminution or degradation <br />of water quality and quantity [Rule 4.04(2)]; control and minimize erosion and siltation [Rule <br />4.04(3)]; control and minimize air pollution [Rule 4.04(4)]; prevent damage to public or private <br />property [Rule 4.04(5)]; and minimize damage, destruction, or disruption of services provided by <br />Proposed Decision and Findings of Compliance 14 September 2009 <br />Permit Renewal 05 Page 34
