Colorado Department of Natural Resources / State Board of Land Commissioners - <br />Proof of use of an existing access from Colorado State Highway 115 to site <br />N. Access for hauling material shall be limited to Colorado State Highway 115 at Mile Marker <br />No. 25 (existing access from Colorado State Highway 115 to the site) Southbound only to <br />U.S. Highway 50. No County Roads shall be utilized for hauling of material. <br />0. The actively mined surface disturbance shall not exceed ten (10) acres. <br />P. The access onto Colorado State Highway 115 shall be protected with a vehicle tracking <br />device, or other means of removing mud from the truck wheels prior to entering the <br />highway. <br />Q. To the extent not otherwise covered by the CDPHE and DRMS permit, Applicant agrees <br />that emissions from material handling (i.e. removal, loading and hauling, etc.), dust from <br />unpaved haul roads, and disturbed surfaces shall be controlled by watering or chemical <br />stabilizers. The stabilizers shall be applied in accordance with recommendations of the <br />manufacturer. <br />R. if a ccnditional use is abandon "A, discontinued or terminated fo. a r°riod of six (6) rnontlic, <br />the approval thereof shall be deemed withdrawn, and the use may not be resumed without <br />approval of a new application. Provided, however, if the holder of the permit intends to, or <br />does temporarily cease the conditional use for six (6) months or more without intending to <br />abandon, discontinue or terminate the use, the holder shall file a notice thereof with the <br />Department prior to the expiration of the six-month period stating the reasons thereof and <br />the plan for the resumption of the use. The requirement of a notice of temporary cessation <br />shall not apply to applicants who have included in their permit applications a statement that <br />the use would continue for less than six (6) months in each year and such fact is noted on <br />the permit. In no case, however, shall temporary cessation of use be continued for more <br />than two (2) years without approval by the Board. The applicant has noted that the mining <br />activity may be in temporary cessation for at least six (6) months, but shall not exceed two <br />(2) years. <br />S.
