In accordance with §34-32-116.5(4)(b) C.R.S., the office shall determine whether the
proposed EPP is to be considered a Technical Revision or an Amendment based on the scope of the
plan. The office has determined that the Schwartzwalder EPP submittal shall be considered a
Technical Revision (TR), and is therefore subject to the review and process requirements of Rule 1.9.1
of the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for Hard Rock,
Metal and Designated Mining Operations.
In accordance with §34-32-127(2)(a)(I)(M) C.R.S., DRMS shall assess a fee based on the estimated cost
of processing the EPP. In accordance with Rule 1.9.1, the Technical
Revision will be considered complete and filed when the appropriate fee is received by the office. After
the office receives the required $1,006 fee, the official review will begin.
Be advised that all other conditions and requirements of Permit No. M-1977-300 remain in full force and
effect.
You may contact me with questions at (303) 866-3567, x8108.
Sincerely,
, W, C
David Bird
Environmental Protection Specialist
cc: Jim Cain - Cotter Corporation
Susan Wyman - Whetstone Associates
Tony Waldron - DRMS
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
