Box 3208 Division Director <br />Muskogee, OK 74402 Natural Resource Trustee <br />Re: Schwartzwalder Mine, Jefferson County, Permit No. M-1977-300, Submittal of <br />Environmental Protection Plante Technical Revision TR-11 <br />Dear Mr. Harlin: <br />The Division of Reclamation, Mining and Safety (DRMS) acknowledges receipt of the Environmental <br />Protection Plan (EPP) submitted 7 August 2009 for Cotter Corporation's Schwartzwalder Mine in <br />Jefferson County. In accordance with §34-32-116.5(4)(b) C.R.S., the office shall determine whether the <br />proposed EPP is to be considered a Technical Revision or an Amendment based on the scope of the <br />plan. The office has determined that the Schwartzwalder EPP submittal shall be considered a <br />Technical Revision (TR), and is therefore subject to the review and process requirements of Rule 1.9.1 <br />of the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for Hard Rock, <br />Metal and Designated Mining Operations. <br />In accordance with §34-32-127(2)(a)(I)(M) C.R.S., DRMS shall assess a fee based on the estimated cost <br />of processing the EPP. Such fee shall be not less than $1,000 and not more than $10,350. In the case of <br />the Schwartzwalder EPP, DRMS assesses a fee of $1,006. In accordance with Rule 1.9.1, the Technical <br />Revision will be considered complete and filed when the appropriate fee is received by the office.
