EXHIBIT "S" <br />Permanent Man-Made Structures <br />Letter of Acknowledgment County Road <br />Date: 2(9)9 <br />To Whom it May Concern: <br />This Acknowledgment is between MULLETT EXCAVATING, LLC 320 CR 241 P.O. BOX 322 WESTCLIFFE, CO <br />81252 the operator of the Mullett Excavating Pit !11 M-2000-115 engaged in the activity of gravel mining and Las <br />Animas County 200 E. First Street, Rcwnt 105 Trinidad, CO 81092, State of Colorado. This agreement will cover the <br />Gravel Pit located on the lands that have a Las Animas Special Use Permit SUP- N 83-005, issued to the Grimsley Family <br />Revocable Trust more particularly described as: Section 19. Township 29 South. Range 61 West. G" P.M. County of Las <br />Animas. State of Colorado. <br />This agreement / acknowledgment is to provide that NiUI.LGI"I' I XCAVA'I'IN(;, HC can carry, on normal gravel mining <br />activities to within the property and within the MLRB Permit M-2=)-115 112c Boundary Line, the right to enter upon <br />the lands and use County Rata 74.2 to ingress and egress the gravel pit. It also provides that the mine operator will repair <br />any damage caused by the mining operation to the driveway access onto the county road. This agreement is to comply <br />with Rule 6.4.19 of the Colorado Division of Reclamation, Mining and Safety/ Mine land Reclamation Board Rules and <br />regulations dealing with any adverse affect on any significant, valuable or permanent man-made structure within 2(X) feet <br />of the affected land. <br />The following conditions will be applied to this agreement: <br />t.) That the operations of said pit does not interfere with the operations and maintenance of (.,as Animas CR 74.2. <br />2.) Mining Excavation will not occur closer than 75 feet from the county road. <br />3.)
