Kerr Coal Company is in the process of obtaining information from the <br />surface landowner regarding water rights to allow for retention of the Tipple Pond, as requested by the <br />landowner. Due to limited availability of the landowner and KCC's senior executive, KCC is requesting <br />the proposed decision be extended until December 18, 2009.
