Surface and Stormwater Discharge Permits <br />The water treatment plant continued to run intermittently as needed (approximately <br />100,000 gallons per month) and discharge sampling was conducted in accordance <br />with the permit conditions and reported monthly to the Water Quality Control <br />Division (WQCD). <br />Stormwater Inspections were conducted on a monthly basis and reported to WQCD in <br />annual stormwater reports. <br />Conditional Water Rights Ruling <br />• Water Usage from the Mine was calculated on monthly basis and reported to <br />Colorado Division of Water Resources (DWR) annually. <br />Air Emissions Permits <br />• Three air emissions permits were self certified and Energy Fuels is currently awaiting <br />final approval from the Air Pollution Control Division (APCD). <br />• Estimated air emissions are calculated on a monthly basis and are reported to APCD <br />annually. <br />Spill Prevention Control and Countermeasure (SPCC) Plan <br />• The Above Ground Storage Tanks (ASTs) on-site are inspected monthly. <br />Radon Monitoring <br />Radon monitoring is conducted continuously and modeled annually. The results of <br />the modeling are reported to the U.S. Environmental Protection Agency (EPA) Indoor <br />Air Program. <br />Tier 2 Reporting <br />• Tier 2 reporting under the SARA Title III regulations is required for diesel fuel stored <br />on-site and is reported to CDPHE on an annual basis. No other Tier 2 reporting is <br />required based on materials stored at the site. <br />The Whirlwind Mine is being maintained so that reopening could occur in a short period <br />of time. If market conditions for uranium improve, the Whirlwind Mine could resume <br />production within a week.
