Drawer 2150 <br />Glenwood Springs, Colorado 81602 <br />Re: Conger Harvesting Area On Site Review <br />Dear Richard: <br />This letter confirms the on site review meeting held on June 1, 1998. Those attending the meeting <br />were Mr. Jeff Franke, Holy Cross Electric Association, Mr. Paul Hernandez, The Gallegos <br />Corporation, and Mr. William P. Balaz, Balaz & Associates, Inc. The parties inspected the site <br />and agreed that the terms of the Agreement dated May 4, 1998 specifying a maximum height of <br />fourteen (14) feet for any equipment or vehicular traffic crossing the Association's right of way <br />and the maintenance of four and one half (4 1/2) feet clearance from any conductor were <br />reasonable and would not cause any problems to the harvesting operation. The parties also <br />agreed that any removal of material or lowering of the grade under the powerline would not be a <br />problem so long as the above clearances were maintained. A five (5) feet diameter area of <br />undisturbed ground would be left around the base of all utility poles in the harvesting area. <br />Gallegos also agreed to work with the Association on any tree removal and that signs warning of <br />the overhead powerline would also be posted. <br />It is our understanding that this on site review meeting fulfills the agreement requirements.
