As you stated in your letter we will be <br />comparing the application content with specific requirements of Rule 3, 6.1, 6.2, 6.4 and <br />6.5 of the Minerals Rules and Regulations of the Colorado Mined Land Reclamation <br />Board for the Extraction of Construction Materials. Following will be the responses <br />addressing your concerns and question in the order given in you letter. <br />6.4 SPECIFIC EXHIBIT REQUIREMNETS- REGULAR 112 OPERATIONS <br />Rule 6.4.3 Exhibit C Pre-Mining and Mining Plan Maps of Affected Land <br />l.) The adjoining surface owners of record are the same as the landowner of the <br />permitted pit area the landowner is the sole owner of all the surrounding lands. <br />2.) Item (d) in Exhibit C states that, " the total area to be involved in the operation is <br />13 acres" is incorrect it should read 23.31 acres this was an error that was missed <br />when preparing the amendment. The mining plan has not been changed to <br />increase the disturbed area any more than the 7.25 acres. This amendment is <br />intended to increase the size of the permit area to include areas that have been <br />deemed affected by vehicle traffic by the DRMS. <br />3.) The mining plans states that the mining will progress from point B to point A, <br />point B is west of point A therefore the mining will be from west to east. The map <br />has been corrected to reflect this part of the mining plan. Mining will proceed to <br />the east at a slope of 3 horizontal to 1 vertical salvaging the topsoil and over <br />burden to be place over the pit floor for reclamation. The mining will also move <br />to the south at a slope 3 horizontal to 1 vertical after the present topsoil stockpile
