1) Backfill all of the pits to two feet above the groundwater level. <br />2) Install a slurry wall or clay liner. <br />3) Provide the Division with a letter from the Office of the State Engineer <br />stating that an augmentation plan is not required until final release and <br />that a bond will not be required in the interim. <br />If the Applicant obtains an augmentation plan prior to final release, then the financial warranty <br />will be adjusted accordingly. <br />21.) It is the Division's interpretation of the mining plan that a maximum of 40 acres will be <br />disturbed at a time for the remainder of the mining phases and reclamation will be concurrent <br />with mining. Of these 40 acres, there will most likely be various levels of disturbance. Please <br />describe the varying levels of disturbance in terms of acreages and the steps that would be <br />necessary to reclaim the disturbance. For example, at the point of maximum disturbance, how <br />many acres of land will need to be completely backfilled? How many acres will need to be <br />partially backfilled? How many acres will need to be topsoiled and seeded? <br />22.) How many acre feet of water is contained in Cell #3 currently? <br />23.) What is the width of the conveyor housing and the height of the conveyor? Are there <br />concrete supports for the conveyor? If so, what are their dimensions and how many of them <br />will there be on average? <br />Exhibit S• <br />24.) Enclosed with this letter is a Memo from Allen Sorenson of the Division concerning <br />setbacks from mining to permanent man-made structures at the site. Please review the <br />enclosed Memo. In essence, in regard to item #32 and your proposal to use a minimum mining <br />setback formula of 3:1 (horizontal to vertical), this commitment need to be more concise. <br />Please commit to the following: <br />The crest of all mined pit slopes will be maintained at all times at a horizontal distance <br />from permanent man-made structures not owned or controlled by the permittee or for <br />which compensation agreements in Rule 6.4.19 have not been executed equal to at <br />least three times the vertical height of the mined slope proximal to the structure. <br />Proposed McCanne Ditch Mitigation Plan: <br />25.) On page 18 of the Adequacy Review Response, you state the relocated McCanne ditch will <br />be lined with bentonite to minimize leakage during the mining process? While the Division <br />agrees that this will minimize leakage from the ditch during the mining process, this may not be <br />a logical long term solution.
