Cattany <br />Division Director <br />Natural Resource Trustee <br />On August 27, 2009 the Division of Reclamation, Mining and Safety received your 112 Construction <br />Materials Reclamation Permit Amendment Application package for the Spring Creek Gravel Pit, File No. M- <br />1994-097. Preliminary review of the information received determined that the following item must be <br />received before the Division can consider your application as being submitted and complete for technical <br />review to begin: <br />EXHIBIT Q - Proof of Mailing of Notice to the Soil Conservation District (Rule 6.3.10): Please <br />submit proof of actual delivery or proof of mailing by Certified Mail, return receipt requested, of <br />Notice of the Application to the Soil Conservation District, to the Board of Supervisors of the Soil <br />Conservation District. The notice provided with the application notes the Southwestern Water <br />Conservation District not the Shavano Soil Conservation District as required. <br />Also a preliminary review of the mining and reclamation maps note the maps do not meet the <br />requirements of Rule 6.2 for scale. Map details must be of sufficient size to clearly show all elements <br />that are required to be delineated by the Act and Rules. The details of the submitted maps are so small no <br />details can be discerned. Ideally the scale should be 1" = 200'. Without proper maps no preliminary <br />review can begin once the application is considered complete. So it would be in Old Castle's best interest <br />to address this issue along with the soil conservation notice. <br />Old Castle's application will not be considered submitted until the information listed above is received and <br />Found sufficient to begin our review. A decision date will be established 90 days from the date of receipt <br />of all of the requested information. Additionally, if you have already published notice you will need to <br />republish notice, after the Division considers the application submitted. This notice must be published <br />once a week for four (4) consecutive weeks, starting within ten (10) days of the date your application is <br />considered submitted. We will notify you when you should initiate republication of your notice.
