Box 430 <br />Nucla, Colorado 81424 <br />Re: J-Bird Mine, File No. M-2005-050, Receipt of 110d, Hard Rock/Metal Mining Reclamation Permit <br />Amendment Application Package <br />Dear Ms. Garrigues: <br />On August 28, 2009, the Division of Reclamation, Mining and Safety received your 110d Hard Rock/Metal Mining <br />Reclamation Permit Amendment Application package for the J-Bird Mine, File No. M-2005-050. As staff explained over <br />the phone an amendment is treated the same as a new application. Per Rule 1.10(2) an amendment to a 110 or 110d <br />permit shall include attachments, maps, and other content as a new application, except where information duplicates the <br />original. However, the applicant shall clearly describe where in the original application and supporting documentation <br />the information may be found. An amendment also requires all the public notice the same as a new application. While <br />the format is up to the applicant it is best to note each required exhibit and either supply the new information or note <br />where in the original application such information may be found. A quick review finds most of the required information <br />missing. Of particular concern to staff is how the EPP changes the mine and reclamation plans and costs associated with <br />those changes. While submitted maps note some changes from the original approved plans, they must be supported by <br />documentation within the required mining and reclamation exhibits. Also, the owner /operator is Riinrock Exploration <br />and Development and maps note Bluerock Energy. While staff understands the relationship the general public does not. <br />It is advisable and preferable to change maps to indicate the current owner/operator to eliminate any possible confusion. <br />Preliminary review of the infonnation received determined that other than the EPP the following items must be received <br />or noted before the Division can consider your application as being submitted and technical review can begin: <br />APPLICATION FORM: <br />EXHIBIT A - Legal Description (Rule 6.3.1(1)): The legal description must identify the affected land, specify <br />affected areas and be adequate to field locate the property. Description shall be by township, range, and section, <br />to at least the nearest quarter-quarter section. A metes and bounds survey description is also acceptable. Also, <br />the street address or lot number(s) may be used.
