b. Legal description of structure:
1. Decreed location: the initial point of survey of Fresh Water
Pond No. 2 is on the dam axis in the East half of Section 9, Township 13 South, Range 90 West,
6th P.M., from whence the Southeast corner of said Section 9 bears South 59° 3d 52" East
2,443.43 feet.

C. Decreed source of water: Water tributary to North Fork Gunnison
River, including water intercepted and collected by works on the West Elk Coal Mine site.
