(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1978-093 <br />INSPECTION DATE 09/01/09 <br />OBSERVATIONS <br />INSPECTOR'S INITIALS PSH <br />The Newett Quarry, File No. M-1978-093, was inspected by Peter Hays with the Division of Reclamation, <br />Mining and Safety (Division) as part of the Division's monitoring inspection program. Michael Golliher with <br />Colorado Lien Company was present during the inspection. The site is located 12 miles east of Buena Vista off <br />Highway 285 on County Road 309 in Chaffee County, Colorado. <br />The Newett Quarry is a 112 limestone operation, permitted for 26 acres. The permit was issued on July 28, <br />1978. The site was previously inspected by the Division on September 29, 2004. The site has an intermittent <br />status with the Division. <br />The approved Mining Plan for the site indicates mining will be accomplished in 7 phases. The operator is <br />currently mining in Phases 1 and 2. The light grey or tan limestone overburden is drilled and blasted to <br />uncover the high calcium limestone. The depth of overburden ranges from 15 to 20 feet. The high calcium <br />Leadville limestone is then drilled and blasted and hauled to the storage area for crushing and sizing. Two 20' <br />highwall benches were observed with 15' of overburden limestone on the second bench. Mining Area B <br />appears unchanged since the previous inspection. According to the last 3 annual reports submitted by the <br />Operator, the site has not been mined for several years. Three stockpiles were observed in the Stockpile <br />Area. A processing plant was not observed during the inspection. Mr. Golliher stated a portable plant is <br />brought in as required. The existing access road through the adjacent landowner's property is not being <br />maintained in anticipation of construction of a new access road on Colorado Lien's property in the future. No <br />mining activity or stockpiled material removal is planned for 2009. <br />The approved post mining land use is wildlife habitat. Stockpiles of overburden and topsoil were observed <br />during the inspection. The stockpiles were vegetated and appeared stable. No erosion was noted during the <br />inspection. Erosion control and sedimentation structures were installed and maintained during the past year. <br />Evidence of recent silt fence installation and water bar construction was observed during the inspection. <br />Canadian Thistle was observed at the mining and stockpile areas. The site is schedule to be sprayed for <br />noxious weeds in the spring of 2010. <br />The Division currently holds a financial warranty of $71,650, which is adequate to complete the reclamation <br />of the site based on the observations from this inspection. <br />An entrance sign was posted and permit boundary markers were observed as required by Rule 3.1.12.
