III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> General Comments <br /> This was a partial mine site inspection, focusing only on drainage structures along segments of the Tie Across <br /> Haul Road (TAHR). Weather was clear and warm and ground conditions were dry. <br /> I was accompanied on the inspection by Roy Karo, SCC Reclamation Manager. <br /> Roads <br /> In the May inspection report, the presence of gullied relief drain ditches on the large fill slope at the location <br /> referred to by the operator(and on the 2009 Rill and Gully Map)as"Coffee Break Hill"was noted, and the need <br /> for riprap replacement/ditch stabilization was stated on the Rill and Gully Map and reiterated in the inspection <br /> report. In the June inspection report it was noted that large riprap had been placed along the roadsides in the <br /> "Coffee Break Hill" location,for use in ditch repairs. <br /> Various ditch down-drain locations and culvert installations in the"Coffee Break Hill"vicinity and other sections of <br /> the TAHR were inspected on the morning of August 14. Locations where maintenance is warranted include the <br /> following (listed in the order in which they were observed): <br /> • Large rock was recently placed along the relief drain ditch on the north side of the road, on the eastern <br /> end of"Coffee Break Hill" (this is Ditch D-9). The rock was somewhat loosely spread along the bottom <br /> of the scoured channel. Further ditch shaping and placement, with closely spaced riprap extended up <br /> the sides of the channel is warranted. <br /> • The ditch steepens as it flows away from the road and is designated Ditch D-9A. Map Exhibit 13-11.4 <br /> (TAHRD "As-Built")depicts a significant length of the lower end of D-9A to be riprap lined. There is <br /> intermittent gully incision along the entire length of D-9A, and most of the originally installed riprap has <br /> been washed out. Maintenance(including ditch shaping and installation of designed riprap or equivalent <br /> TRM liner) is warranted along the entire section, from the upper end of the recently placed rock on D-9, <br /> to the lower end of D-9A. <br /> • Large rock had been loosely spread along the south side road ditch (D-8), across from D-9. The rock <br /> was not properly placed to be effective. The scoured ditch segment needs to be shaped, and the ditch <br /> lined with properly placed riprap or equivalent TRM. <br /> • The north side relief drain ditch to the west of D-9/9A is D-7. Map Exhibit 13-11.3"As Built"depicts a <br /> significant length along the lower segment of the channel to be riprapped, with a silt fence installation at <br /> the lower end of the ditch. As with D-9A, there is intermittent erosion along the length of the channel, <br /> and much of the original riprap has been washed out. The silt fence has also been washed out. Large <br /> rock was recently dumped and spread along a portion of the upper segment of the ditch, but was not <br /> installed so as to effectively prevent downcutting and side-scour. The entire length of D-7 will require <br /> grading/shaping and proper installation of design riprap or equivalent TRM liner. In place of the silt <br /> fence at the lower end of the ditch, a series of trenched in large rock checks would likely be more <br /> effective, given the concentrated flow in that location. <br /> • On the south side of the road, across from D-7, there is another road ditch, where large rock was <br /> recently loosely spread along the upper section of the ditch, but the lower sections of the ditch are <br /> intermittently gullied along a several hundred foot segment down to a wheatfield at the edge of the road <br /> corridor. Proper ditch shaping, and riprap or equivalent TRM installation is warranted. <br /> • Erosional scour was observed at the outlet end of Culvert C-13(rock had been installed originally but <br /> maintenance is warranted along a 30 foot segment below the outlet). <br /> • Culvert C-16 was partially blocked at the outlet end and maintenance is warranted. <br /> • Culvert C-18(across the Coal Hauler's Road)was partially blocked at inlet and outlet; will need to be <br /> maintained or replaced. <br /> The operator needs to conduct a comprehensive check of all drainage structures along the Tie Across <br /> Road, and perform maintenance as warranted (including above noted locations),to be fully completed <br /> by October 30, 2009. <br /> 3 <br />
