i <br /> M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.Bill Bear represented the <br /> Bear Coal Company during the records check.No representative was present for the field inspection. <br /> Roads <br /> The paved haul road was passable., There was no debris on the road and the road cable guard was in place. <br /> Sites and Markers <br /> The mine id sign and its post were on the ground at the top of the hill and need to be put back up. The surface <br /> disturbance markers were up around the site. The"no trespassing"sign was on the gate but the gate was open. <br /> H. drology <br /> There was no standing water in the sediment pond. The pond's primary and secondary spillways were <br /> functional.The pond's embankment was stable.The collection ditch leading into the north side of the sediment <br /> pond and the entrance road culvert leading into the south side of the sediment pond had sufficient capacity. The <br /> riverside berm was in place. The water level in the river had gone down considerably from the last inspection. <br /> There were no problems with the two alluvial wells. Caps were on both of the well pipes. <br /> The hillside spring water treatment pond was discharging at about 10 to 15 gpm. The treatment pond discharge <br /> was the usual orange color which has been found to be in compliance with receiving stream standards. The <br /> water level in the treatment pond was about 8 inches below the horizontal pipe,as is typical for this pond. The <br /> hillside spring was contained in its'channel and was flowing into the treatment pond. <br /> Noxious Weeds <br /> There were patches of thistle on the reclaimed road leading to the reclaimed portal area. Some of the thistle <br /> appears to have been sprayed but there also appears to be new growth and it needs to be sprayed. There are <br /> scattered occurrences of thistle on the reclaimed portal area as well and these too need to be sprayed.Tamarisk <br /> continues to grow at the hillside spring area and at the hillside spring water treatment pond. Some of the <br /> tamarisk at the treatment pond had been cut down but the remaining plants need to be dealt with properly. <br /> Reclamation <br /> The west side portal area continues to show signs of slope instability.New cracks in the backfill on the ground <br /> and up against the rock cliff were evident.There was an obvious odor of smoldering coal at this location.The <br /> east side fan portal and road reclamation were stable. The vegetative cover was good on the reclaimed hillside. <br /> However,there was a lot of cheat grass on the flat facilities area. <br /> Records <br /> The required mine records were located at the Bowie No.2 Mine office,as shown on the records checklist. <br /> c:/word2007/bear3/insp0809 <br />
