III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator <br /> during the inspection. <br /> Facilities <br /> There was a lot of activity at the loadout during the inspection.Coal haul trucks were bringing in coal and <br /> unloading it into the grizzly.A front end loader was transferring stockpiled coal into the grizzly as well. The <br /> crusher/screener was in operation,as was the rail car loading structures.In spite of all of this activity,there were <br /> no problems with fugitive dust going offsite.There was very little stockpiled coal on site. <br /> There were no problems with the coal handling structures and at the substation,material storage area and the <br /> loadout office.There were no leaks at the fuel facility. <br /> Hydrology <br /> The sediment control system was functioning properly at the loadout.The bottom of the east side sediment pond <br /> was wet but there was no standing water.The primary and emergency spillways were in place and were <br /> functional.The primary discharge gate was in the closed position.The pond embankment and pond inslopes <br /> were well vegetated.The west side dugout pond was dry. The combination spillway was clear of debris. <br /> The straw bales and silt fence were in place at the railroad track small area exemption.The culverts and ditches <br /> at the loadout had capacity. <br /> Topsoil Stockpiles <br /> The vegetative cover on the topsoil stockpiles was good but was turning brown due to the time of the year. <br /> Topsoil signs were up on the stockpiles.The collection and diversion ditches associated with the east side <br /> topsoil stockpile were in place and had sufficient capacity.The collection/diversion berm around the west side <br /> topsoil stockpile also was in place. <br /> Roads <br /> The paved main haul road was in good condition.The guard rail was in place.The graveled east side entrance <br /> road was also in good condition. The light use road along the tracks was dry and passable.There was only a <br /> little coal dust that had been tracked onto the main road by the coal haul trucks and it was not a problem. <br /> Signs and Markers <br /> The permit boundary markers were up around the site.The mine identification signs were up at the main <br /> entrance, east entrance and alongside the back road near the railroad tracks. <br /> c:/word2007/terror/insp0809 <br />
