III. COMMENTS - COMPLIANCE <br /> Colowyo C-1981-019 <br /> 18 August 2009 <br /> Pg 1/9 <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken <br /> during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Colowyo Mine conducted by Jim Stark of <br /> CDRMS. The inspection was conducted on 18, 19 and 20 August 2009, Ryan <br /> Pawlowski of CCC accompanied me on 18 and 19 August 2009 and Jennifer Sekulski- <br /> Barton of CCC accompanied me on 20 August 2009. The mine was actively mining <br /> coal and hauling coal to the loadout at the time of the inspection. The weather was <br /> warm and sunny and the ground was dry. <br /> During the inspection Colowyo hand delivered a signed copy of the Technical <br /> Revision 72 decision form, agreeing to the new stipulations placed on the permit as a <br /> result of the revision. <br /> Roads: - The main access road and haul road to the Gossard Loadout is a paved <br /> road. The road was well maintained and in good condition. <br /> - The light-use road in the Taylor Draw was well maintained and stable. The road was <br /> bladed by Bower Brothers for improved access to the West Taylor Pond (for <br /> cleaning). There were no ruts or erosional problems noted on the road at the time of <br /> the inspection. The portion of the road that continues to the West Taylor Pond was <br /> also stable and well maintained (this portion was also bladed by Bower). There are a <br /> few low spots on the road that collect water and, although they are partially full and <br /> muddy, they are not a problem at this time of the year. <br /> - The haul roads in the East Pit, West Pit were dry. Colowyo was actively watering <br /> these roads to help control fugitive dust. All the roads were stable and well <br /> maintained at the time of the inspection. No erosional problems were noted on any <br /> of the roads. <br /> - There is a network of roads in the South Taylor area, including the main haul road <br /> that runs from the box cut through the old Section 16 Pit, a spur to the C-C' <br /> underdrain area of the East Taylor Fill and a spur to the E2-Seam where ICG is <br /> performing highwall mining operations. All of these roads were being actively <br /> watered to control fugitive dust at the time of the inspection. All of the roads were <br /> surfaced with rock and remain stable and well maintained and there were no ruts or <br /> erosional problems noted on any of these roads. There is also a road that runs <br /> through the ICG work area that goes to the B-B' and A-A' underdrain areas of the <br /> West Taylor Fill. This road spur was also well maintained and stable. <br /> - The Sturgeon road is well maintained and stable. The road is only used to access <br /> the Section 28 Pond. The gravel surfacing on the road is in place as required. The <br /> Missouri crossings are in place, stable and functioning as designed. The roadside <br /> ditches were all clear and the alternate sediment control structures used (straw <br /> waddles and rock check dams) appeared to be keeping sediment out of the <br /> drainage south of the road. <br />
