In addition, on July 24, 2009 we <br />mailed notice of the application via certified mail to all owners of record of surface rights to the <br />affected land and all owners of record of lands that are within 200 feet of the boundary of the <br />affected land. <br />We have enclosed the following items for your records: <br />• A copy of the Affidavit of Publication from "The Tribune". <br />• A copy of all the certified mailing receipts and return receipts that we received. Notices <br />to one of the owners of land within 200 feet of the boundary of the affected land (83rd <br />Joint Ventures LLC) were returned to us as being "undeliverable" so we researched the <br />owner on the Secretary of State's website to find a current address and then sent them a <br />new notice on July 31, 2009; it was delivered. Three of the owners (Dieterle, Burke and <br />Wellnitz) did not claim their notice from the post office within 30 days and so their <br />notices were returned to us.
