Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation Mining and Safety (DRMS) has done a Preliminary Adequacy Review (PAR) <br />of the above referenced 112c;application. Please find attached a review work sheet. Issues that need to <br />clarified or corrected are noted in bold italics. <br />The biggest issue which is already being addressed is the lack of information in the Public Notice for <br />submission of comments. It is staff understands that a new notice is already being prepared and should <br />be published this week. Please provide staff with a copy of the initial notice so that the final date for <br />comments can be established' and reviewed to ensure correctness. Per Rule 1.4.1(13) "failure to publish <br />the notice pursuant 1.6.2(1)(d) shall add a sufficient number of days for the required notice to be <br />accomplished. An additional time period, as determined by the office may be added for the office to <br />make a decision." For a 112c'application without objections the time period shall not exceed 90 days <br />from the close of comment period. The original decision date was set for September 14, 2009. That date <br />is now moot because of the publishing error. Once staff has the requested copy of the notice a firm <br />decision date will be set. It should be noted that if all issues are addressed while the notice and <br />comment period run a decision can be rendered quickly if no objections are received.
