The Division of Reclamation Mining and Safety (DRMS) has done a Preliminary Adequacy Review (PAR)
of the above referenced 112c;application. Please find attached a review work sheet. Issues that need to
clarified or corrected are noted in bold italics.
The biggest issue which is already being addressed is the lack of information in the Public Notice for
submission of comments. It is staff understands that a new notice is already being prepared and should
be published this week. Please provide staff with a copy of the initial notice so that the final date for
comments can be established' and reviewed to ensure correctness. Per Rule 1.4.1(13) "failure to publish
the notice pursuant 1.6.2(1)(d) shall add a sufficient number of days for the required notice to be
accomplished. An additional time period, as determined by the office may be added for the office to
make a decision." For a 112c'application without objections the time period shall not exceed 90 days
from the close of comment period. The original decision date was set for September 14, 2009. That date
is now moot because of the publishing error. Once staff has the requested copy of the notice a firm
decision date will be set. It should be noted that if all issues are addressed while the notice and
comment period run a decision can be rendered quickly if no objections are received. At this point it
could be the first week of October.
