Based on the extent of erosion and associated remedial work, the Division believes that it would be <br />premature to evaluate the erosional stability of slopes and permanent channels in the South <br />Extension area for Phase I bond release within SL-2. As a result, the Division plans to exclude the <br />South Extension area from any proposed approval decision for SL-2. That being the case, we do <br />not intend to conduct a detailed review of the SL-2 application materials pertaining to the South <br />Extension Area, and we do not intend to include the South Extension area as a part of the site <br />inspection for SL-2. The South Extension area is that portion of the II-W permit area within <br />Sections 26, 27, 34, and 35; T5N, R88W. <br />Please advise if Seneca Coal Company has comments or objections to the Division's plans <br />regarding review and handling of the SL-2 application as it pertains to the South Extension area, <br />prior to the SL-2 site inspection. <br />If you have any questions, please contact me. <br />Sincerely, <br />Aaniel T.
