N. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Kent Gorham of the Colorado Division of Reclamation,Mining <br /> and Safety. Jim Jarvis represented GCC Energy during the inspection. Ground conditions on this day were <br /> dry and the weather was clear and warm. <br /> Roads <br /> King I —The main access/haul road was found in excellent condition. A drainage swale, as shown on <br /> Map C-4, is located between the East and West sediment pond. This Swale prevents storm runoff from <br /> leaving the site by diverting this runoff from the lower yard area into the East sediment pond. <br /> King 11-The haul/access road was well maintained. Haul truck traffic was significant on this day with <br /> many trucks using the entrance for staging while waiting to be loaded with coal. <br /> Hydrologic Balance <br /> King 1 Ponds - The east and west ponds continue to hold small pools of water, several feet below the <br /> principal spillway discharge elevations. The outlet end of the secondary spillway IF pipe)of the west <br /> pond remained exposed (soil had been removed from it during the October 2008 inspection). <br /> The east and west - <br /> sediment ponds <br /> work together to "eo <br /> treat storm runoff <br /> from the disturbed <br /> area. An eight inch <br /> PVC pipe(shown <br /> at right) connects <br /> the West pond to <br /> the East pond and <br /> is designed to <br /> adequately treat <br /> runoff in <br /> accordance with <br /> Appendix I I of the <br /> approved permit. <br /> The West pond - <br /> emergency spillway <br /> (sharp crested weir) <br /> has also been <br /> recently re-built. If this.work is now complete, the operator should re-certify this structure to ensure <br /> that work has been completed in accordance with the approved design. <br />
